What You Need To Know:

We love running promotions for you guys and we want to be as clear as possible on how you enter, and how the prize is drawn. Please read the nuts and bolts below for the full details.

1. We know that there are ASOS lovers all around the world, but this promotion is only to residents of the United Kingdom and United States of America aged 18 or over. So that we are completely fair, anyone employed by us, including freelancers and contractors, their families (parents, children, siblings, spouse and life partners) and professionally connected to this promotion is not allowed to enter.

2. You don’t have to buy anything to take part in this promotion, but you do need your own Instagram account and access to the internet in order to enter.

3. Promotion Period: You can enter between 10:00 GMT (05:00 EST) on the 4 February 2022 and 23:59 GMT (18:59 EST) on the 6 February 2022.

4. To Enter: Entering this promotion is simple, just log onto your Instagram account (or create one for free), follow @Topshop, and comment underneath the Promotional Post tagging a friend and what you would buy with the vouchers to be entered into the Prize Draw.

5. You must continue to follow @Topshop on Instagram, for a period of 4 weeks following the end of the Promotion Period in order to be contacted if you are a winner.

6. We’re sorry, but a maximum of 2 entries is permitted per person per day, during the Promotion Period, and all subsequent entries will be disqualified. No person may win more than 1 Prize.

7. The Prizes: There will be a total of 11 prize winners. Each winner will win 1 x £/$ 200 ASOS Voucher.

Further Prize Details and Conditions:

a) The winner and runners-up will receive an individual gift voucher code via email to register it to their ASOS account as credit. An ASOS account will need to be set up to use the gift voucher (if the winner hasn’t done this already).

b) For any UK winners, unless otherwise limited or prohibited by law, the gift voucher will have its own expiry date of 24 months from the date of issue. The expiry date will be made clear when the voucher is sent to the winner and runners-up.

c) For any USA winners, the voucher has no expiry date.

d) Gift vouchers can be used as part or full payment against eligible items on the ASOS websites (this does not include ASOS Marketplace or the purchase of other ASOS gift vouchers).

e) Gift vouchers can be used against shipping costs.

f) Unless otherwise required by law, no cash refunds will be given but any balance remaining on the gift voucher is locked to the winner’s account and can be used against future purchases.

9. Winner Selection: So that you know we’ve selected our winners fairly from all the valid entries we receive, the random draw will be carried out by PromoVeritas, the independent promotional verification service to select 11 provisional winners. The draw will take place within 5 working days of the end of the Promotion Period.

10. Contacting the Winners: We’ll contact the provisional winners via the social media account used to enter within 5 working days of Winner Selection and will be asked to provide evidence of identity and eligibility. Once eligibility has been confirmed, they will then be confirmed as a winner. Reasonable efforts will be made to contact the winners. If a winner does not respond to the initial contact within 14 days, we reserve the right to disqualify that entrant and award the Prize to a reserve selected in the same manner. Reserve winners may have less time to respond.

11. Prize Acceptance: If you are one of our lucky winners, we will contact you to arrange your prize as soon as we can and they will be delivered to you within 28 days of the date you accept the Prizes when contacted by ASOS, in accordance with the details provided by you. In the unlikely event that your Prize doesn’t arrive within 28 days of your Prize Acceptance, you’ll have a further 28 days to inform us by emailing the team at: win@asos.com. If you don’t let us know within this time frame, we will reserve the right to not reissue the Prize or limit its value at our sole discretion.

12. Moderation: We can’t accept any entries which we think:

a. Contain any content that is likely to be considered offensive by us or could reflect negatively the name, reputation, or goodwill of [insert brand] or any brand partner;

b. Include trademarks, logos, or copyrighted material not owned by you or used without the right holder's prior written permission (including famous names, company names, etc.);

c. Defames, misrepresents, or insult other people or companies, including, but not limited to [insert brand] (including its partners); or

d. Promotes any political agenda.

13. Provided no objection from the winners is received, we’ll make a winners list available stating the surname and county of residence of the winners 4 weeks after the close of the Promotion Period, for a period of 8 weeks. It will be available by sending a request via email to win@asos.com. Winners can object to their surname or county of residence being published or request for the amount of information being published to be reduced during the Winner Notification process. However, without prejudice, we will provide winner information to the Advertising Standards Authority on reasonable request.

14. Sorry, but you can’t transfer a Prize to someone else or exchange it for a cash alternative.

15. If, for reasons we can’t control, a Prize is no longer available, we’ll offer you an alternative Prize which we hope you’ll still love but which will definitely be of equal or greater value.

No one likes the small print, but we need to let you know about some other important stuff too and make you feel comfortable that we run our promotions properly, fairly (and legally!):

16. Data Privacy: We care a lot about the security of your personal data and it will be held in accordance with our Privacy Policy here: https://www.asos.com/privacy-policy/ and will only be used for the purposes of this promotion save where you have opted in to receive communications from ASOS. We will only share your data with our Fulfilment Partners for the to fulfil this promotion.

17. If the Promotion is not capable of running as planned for reasons including but not limited to tampering, unauthorised intervention, fraud, dishonesty, technical failures, or any other causes beyond our control which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion, we reserve the right to disqualify any individual who tampers with the entry process or does not comply with these Terms & Conditions, or invalidate any affected entries and/or to cancel, modify or suspend the Promotion.

18. No responsibility can be taken for entries which are lost, delayed, corrupted, damaged, misdirected or incomplete or which cannot be delivered for any technical, delivery or other reason. Proof of sending will not be accepted as proof of receipt. We can’t guarantee continuous or secure access to Instagram.

19. This Promotion is in no way sponsored, endorsed or administered by, or associated with Instagram. You are providing your information to the Promoter and not to Instagram, and Instagram is not responsible for any element of this Promotion.

20. We and our associated agencies and companies are not liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense or damage which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Promotion or accepting or using the/a Prize(s), except for any liability which cannot be excluded by law. However, nothing will exclude our liability for death or personal injury as a result of its negligence.

21. We won’t be liable for any delay or failure to comply with our obligations for reasons beyond our reasonable control arising from but not limited to Acts of God, global or regional epidemic or pandemic, adverse weather conditions, fire, industrial dispute, war, terrorist activity, hostilities, political unrest, riots, civil commotion, plague or other natural calamities, or any other circumstances of ours.

22. If any part/s of these Terms & Conditions are legally ruled to be invalid, illegal or unenforceable, the remainder will not be affected and will continue in full force and effect.

23. By entering, you will be deemed to have agreed to be bound by these Terms & Conditions.

24. If there is a discrepancy between these Terms & Conditions and those in any promotional material, these Terms & Conditions will prevail.

25.These Terms & Conditions are governed by English law and their interpretation and application will be subject to the exclusive jurisdiction of the courts of England and Wales.
